Nitger Video Watermark Editor - User Agreement

Welcome to Nitger, a professional and intuitive video watermark editing application ("App") designed exclusively for content creators who strive for excellence in every detail of their work. This User Agreement ("Agreement") governs your use of the Nitger App (including all features, functions, content, and services provided through the App, collectively referred to as the "Services").

By downloading, installing, registering with, or otherwise using the Nitger App, you ("User" or "You") acknowledge that you have read, understood, and agree to be bound by this Agreement, as well as any updates, modifications, or supplements to this Agreement that we may publish from time to time. If you do not agree to any terms of this Agreement, you must immediately cease using the App and uninstall it from your device.

Nitger is committed to providing a seamless, immersive, and secure editing experience, and this Agreement is designed to protect both your rights as a user and our rights as the provider of the App and Services. Please read this Agreement carefully before using the App.

Nitger does not require users to create or register an account to access and use the core features of the App. This "account-free" access is designed to simplify your experience and reduce barriers to using the App’s watermark editing tools.

To use the App, you must be at least 13 years of age. If you are under the age of 18, you must obtain the consent of your parent or legal guardian before using the App, and your parent or legal guardian must agree to be bound by this Agreement on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements, and that any information you provide (if applicable) is true, accurate, and complete.

Even without an account, you are responsible for maintaining the security of your device and ensuring that no unauthorized person accesses or uses the App through your device. You agree to notify us immediately if you become aware of any unauthorized use of the App via your device.

When using the Nitger App, you agree to comply with all applicable laws, regulations, and this Agreement. You further agree to the following usage rules:

• You will use the App only for lawful purposes. You will not use the App to edit, add watermarks to, or distribute any video content that is illegal, infringing, harmful, offensive, or violates the rights of any third party (including but not limited to copyright, trademark, privacy, or publicity rights).
• You will not modify, reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, or create derivative works based on the App or any part thereof, unless expressly permitted by applicable law.
• You will not use the App in a way that disrupts, impairs, or interferes with the normal operation of the App, or with the use and enjoyment of the App by other users. This includes, but is not limited to, sending spam, viruses, or malicious code through the App, or overloading the App’s servers.
• You will not use the App to add watermarks to content that you do not own or have the legal right to use. You are solely responsible for ensuring that you have all necessary permissions, licenses, or rights to edit and watermark any video content using the App.
• You will not use the App to engage in any activity that violates the terms of service of any third-party platform (e.g., social media platforms like YouTube, Instagram, TikTok) where you may share the watermarked videos created with Nitger.

Nitger reserves the right to monitor your use of the App to ensure compliance with this Agreement. If we determine, in our sole discretion, that you have violated any of these usage rules, we may suspend or terminate your access to the App without prior notice, and you may be held liable for any damages resulting from your non-compliance.

All intellectual property rights in and to the Nitger App (including but not limited to the App’s code, design, interface, graphics, logos, icons, text, features, and functionality) are owned by Nitger or its licensors. These rights are protected by copyright, trademark, patent, and other applicable intellectual property laws and treaties.

This Agreement grants you a limited, non-exclusive, non-transferable, revocable license to use the App and its core features for your personal or non-commercial use only. You may not sell, rent, lease, sublicense, distribute, or otherwise transfer the App or your right to use it to any third party.

With respect to the video content you edit and watermark using the App ("Your Content"), you retain all intellectual property rights in Your Content, provided that Your Content does not infringe any third-party rights. Nitger does not claim ownership of Your Content. However, by using the App to create watermarked content, you grant Nitger a non-exclusive, worldwide, royalty-free license to process Your Content solely for the purpose of providing the App’s Services (e.g., rendering the watermark on your video, saving your edited content to your device).

You agree not to use any of Nitger’s intellectual property (including the "Nitger" name, logo, or brand elements) without our prior written permission. Any unauthorized use of our intellectual property may constitute a violation of this Agreement and applicable law.

Nitger reserves the right to modify, update, or discontinue the App (or any part of the App, including features, functionality, or content) at any time, with or without prior notice to you. We may also update or modify this Agreement from time to time to reflect changes in the App, applicable laws, or our business practices.

When we modify this Agreement, we will post the updated version within the App (e.g., in the "Settings" or "Legal" section) and indicate the effective date of the update. Your continued use of the App after the effective date of the updated Agreement constitutes your acceptance of the modified terms. If you do not agree to the updated Agreement, you must stop using the App and uninstall it from your device.

We will make reasonable efforts to notify you of significant changes to the Agreement (e.g., via in-app notification), but it is your responsibility to review the Agreement periodically to stay informed of any updates.

Your right to use the Nitger App will continue until terminated in accordance with this section.

You may terminate this Agreement at any time by uninstalling the App from your device and ceasing all use of the Services.

Nitger may terminate this Agreement and your access to the App at any time, with or without cause, and with or without prior notice, if: (a) you violate any term of this Agreement; (b) you engage in any illegal or unauthorized use of the App; (c) we determine that your use of the App poses a risk to other users, the App, or our business; or (d) we discontinue the App or any part thereof.

Upon termination of this Agreement, all licenses and rights granted to you under this Agreement will immediately cease. You must uninstall the App from your device and delete any copies of the App in your possession. Sections of this Agreement that by their nature should survive termination (including but not limited to intellectual property rights, disclaimers of warranty, limitations of liability, and indemnification) will continue to apply after termination.

THE NITGER APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. NITGER EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND RELIABILITY.

Nitger does not warrant that: (a) the App will be error-free, uninterrupted, or secure; (b) the App will meet your specific requirements or expectations; (c) any errors in the App will be corrected; (d) the App will be compatible with all devices or operating systems; or (e) the quality of any content, services, or products obtained through the App will meet your standards.

Your use of the App and any content or services obtained through the App is at your own risk. Nitger is not responsible for any damage to your device, loss of data, or other harm resulting from your use of the App, including but not limited to harm caused by viruses, malware, or third-party interference.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. In such cases, any implied warranties will be limited to the maximum extent permitted by law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NITGER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR SERVICES, WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF NITGER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nitger’s total liability to you for any claims arising out of or related to this Agreement or your use of the App shall not exceed the amount you paid (if any) to download or use the App. If you did not pay anything to use the App, Nitger’s liability shall be limited to $100 USD.

Some jurisdictions do not allow the limitation or exclusion of liability for consequential or incidental damages, so the above limitations may not apply to you. In such cases, Nitger’s liability shall be limited to the maximum extent permitted by law.
